SuperDuperVision Terms of Service Agreement
This Terms of Service Agreement (the “Agreement”) is a legally binding contract between you (“User” or “you”) and PsychCore (“PsychCore,” “we,” “us,” or “our”), governing your use of the SuperDuperVision web application (the “Service”). By accessing or using the Service, you agree to be bound by this Agreement.
1. Acceptance of Terms
By accessing or using the Service, you agree to comply with and be bound by the terms and conditions set forth in this Agreement. If you do not agree to all the terms and conditions of this Agreement, you must not use the Service.
2. Description of Service
SuperDuperVision is a web application that provides various features and functionalities related to managing the development of behavior analysts and tracking their progress toward certification.
3. User Accounts
You may be required to create an account to access certain features of the Service. You agree to provide accurate and complete information when creating an account and to keep your account credentials secure. You are solely responsible for any activity that occurs under your account.
4. User Content
You retain ownership of any content you upload, submit, or otherwise make available through the Service (“User Content”). By uploading, submitting, or making User Content available, you grant PsychCore a non-exclusive, royalty-free, worldwide license to use, modify, reproduce, distribute, and display such User Content solely for the purpose of providing the Service. You represent and warrant that you have all necessary rights to grant such license to PsychCore. No personally identifying information from your content will be shared at any time.
5. Prohibited Conduct
You agree not to engage in any of the following prohibited activities:
a. Violating any applicable laws or regulations;
b. Uploading, posting, or transmitting any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable;
c. Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity;
d. Interfering with or disrupting the integrity or performance of the Service or the data contained therein;
e. Attempting to gain unauthorized access to the Service or its related systems or networks.
6. Intellectual Property Rights
All intellectual property rights in the Service, including but not limited to copyrights, trademarks, trade secrets, and patents, are owned by PsychCore or its licensors. You agree not to modify, adapt, reproduce, distribute, or create derivative works based on the Service.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. PSYCHCORE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8. Limitation of Liability
UNDER NO CIRCUMSTANCES SHALL PSYCHCORE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.
9. Indemnification
You agree to indemnify and hold PsychCore harmless from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of the Service or any violation of this Agreement.
10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the United States and the Commonwealth of Virginia, Washington State, and Delaware State, without regard to its conflict of law principles.
11. Changes to the Agreement
PsychCore reserves the right to modify or replace this Agreement at any time. It is your responsibility to review this Agreement periodically for changes. Your continued use of the Service after any modifications to this Agreement constitutes acceptance of those changes.
12. Termination
PsychCore may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach this Agreement.
13. Entire Agreement
This Agreement constitutes the entire agreement between you and PsychCore regarding your use of the Service and supersedes all prior agreements and understandings, whether written or oral.
